Perlindungan Hukum Dokter Dalam Perspektif Undang Undang Tentang Rumah Sakit

Abstract

One of the laws and regulation protecting the medical professions protecting the medical profession is Article 46 of Hospital Law No.44 of 2009 concerning hospitals stating that the hospital is legally liable for any harm resulting from negligence by health personnel in the hospital. As far the purpose of this reseach is to know the implementation of hospital responsibility legally to all losses caused by negligence done by doctor at hospital, and know legal protection for doctor in case of demands of patient compensation in hospital connected with working relationship between doctor and hospitals. The reseach method used is normative juridical , that is by doing review and study of law through literature study. From the results of the study it can be concluded that first, there has not been a thorough application of the hospital’s legal responsibility for all losses caused by negligence by health personnel in the hospital. Secondly, Legal protection of doctors, especially thoserelated to Article 46 of Law No.44 of 2009 Concerning Hospitals has not been clearly visible because it is not implemented in the position of doctors as professionals is still very weak.
