Pengurusan wakaf yang mempunyai urus tadbir dan tatakelola yang sistematik akan berupaya menghasilkan pulangan yang optimum sekaligus meningkatkan ekonomi umat Islam. Di Malaysia, pengurusan wakaf adalah tertakluk kepada enakmen yang ditetapkan mengikut Majlis Agama Islam Negeri masing-masing. Justeru, sejajar dengan pemerkasaan konsep Malaysia Madani yang memetakan strategi tatakelola dan pentadbiran secara berkesan, menekankan kepada pemerkasaan ekonomi dan budaya yang berteraskan nilai dan etika, kajian ini akan menelusuri mekanisma pengurusan wakaf pendidikan dan kaitannya dengan konsep madani yang dilaksanakan oleh Wakaf Pulau Pinang (WPP). Selaku institusi yang sah dan diiktiraf sebagai pengendali harta wakaf, kajian ini juga akan mengenalpasti isu-isu terutamanya yang melibatkan perundangan memandangkan terdapat harta wakaf yang digunakan bagi tujuan pendidikan oleh WPP. Metodologi kajian dilakukan kaedah kualitatif dengan mengumpulkan data melalui kajian kepustakaan dan kajian lapangan yang menggunakan kaedah temu bual t idak berstruktur. Hasil kajian menunjukkan terdapat pelbagai mekanisma dan kaedah yang dilaksanakan oleh WPP bagi memastikan urus tadbir harta wakaf secara telus dan berintergriti. Therefore, this research study on the Islamic tourism development based on the Maqasid Shari’ah framework. Qualitative method has been used which based on the library research such as books, articles, journals review and any other related materials. Finding of this research show that the development of Islamic tourism is an important and market advantage which in conformity with the Maqasid Shari’ah perspective in order to bring the social welfare and justice for the public interest (maslahah). As conclusion, the development of the Islamic tourism should be based on the preservation of five necessities (daruriyyah al-khamsah), namely, the preservation of religion (din), the preservation of life (nafs), the preservation of intellect (’aql), the preservation of progeny (nasl) and the preservation of wealth (mal).
