There are rising voices at present calling for the wife’s&#13;
sharing ownership of her husband’s property that is earned during&#13;
their marital relationship, on the premise that such property is earned&#13;
due to the mutual effort of both spouses, with the wife carrying out&#13;
house chores and thus allowing the husband time to work, or with&#13;
both having jobs and contributing to the welfare of the family and&#13;
maximizing their property. Some countries legalized such matrimonial&#13;
property, binding the husband to share with his wife whatever he&#13;
earns during their marital relationship. In this study, I examined the&#13;
corroborating proofs of such a stance and concluded that each spouse&#13;
is independent in terms of ownership, wealth, income, and disposal. I&#13;
also concluded that financial transactions between the spouses are&#13;
liable to legal rulings on financial transactions in general and that if&#13;
the two spouses dispute the ownership of any property, the claimant&#13;
is bound to prove the validity of such a claim.

In every age, there are always new issues and emergent questions that merit juristic and scholarly investigation and research, inviting Muslims to pay due attention to these issues and handling them from a Shari‘ah perspective. However, the developments and changes in this age are huge and dramatic, giving rise to a lot of questions whose Shari‘ah rulings need clarification. Hence, fiqh councils have been established, many conferences have been held, a lot of books have been authored and new departments have been created in Shari‘ah colleges to study contemporary issues and to find their rulings. In the same vein, I discuss in this research the importance of comparative fiqh for the juristic study of contemporary and emergent issues. This research is divided into three parts and conclusion.  In the first part I discuss the definition of comparative fiqh, its subject matter and its importance. The second part explains the concept of contemporary issues and their characteristics. Part three discusses comparative fiqh and contemporary issues. The conclusion includes the most important findings and recommendations.

تعالت في الوقت الحاضر بعض الدعوات المطالبة بوجوب مشاركة الزوجة فيما يكتسبه الزوج من أموال أثناء قيام العلاقة الزوجية، بدعوى أن هذه الأموال جاءت نتيجة الجهد المبذول من الزوجين معا سواء من خلال العمل المنزلي للمرأة الذي مكن الزوج من العمل الهادئ خارج البيت، أو من خلال عمل الزوجين خارج المنزل والإسهام معا في تكوين مال الأسرة، وقد قامت بعض الدول بتقنين ذلك والالزام بمشاركة الزوجة في كل ما يكتسبه الزوج من أموال بعد الزواج وأثناء قيام العلاقة الزوجية، وقد قمت في هذا البحث بمناقشة أدلة إلى من ذهب إلى ذلك، وخلصت في هذا البحث إلى أن الزوجان في شؤون الملكية والثروة والدخل والتصرفات مستقلان تماما، وعقد الزواج لا يرتب أي حق لأحدهما على الآخر في الملكية والدخل، إلا الحقوق المقررة شرعا، وأن التعاملات المالية بين الزوجين تُطب ُق عليها الأحكام الشرعية للمعاملات المالية بشك ل عا م، وأنه إذا اختلف الزوجان في ملكية شيء فلا ب َّد للمدعيمنهما أن يقدم الإثبات على صحة دعواه، والأولى أن يصلحا بينهما، فالصلح خير.
